These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, and services (collectively, the "Services") provided by Let's Ride LLC ("Let's Ride," "we," "us," or "our"). By using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
You must be at least 16 years old to use the Services. We do not knowingly allow anyone under 16 to register. If you are 16 or 17, you may use the Services only with the permission of a parent or legal guardian, and by using them you confirm you have it. Where the law requires a parent's permission through your device's app store (such as Texas's app store law), we use the age information, and any parent's answer, that the app store gives us. If you are the parent or guardian of a rider under 18 and you allow them to use the Services, please read these Terms with them, especially Section 5. If you use the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
You are responsible for safeguarding your account credentials and for any activity that occurs on your account. Notify us immediately at support@letsrideoffroad.com if you suspect unauthorized access. We are not liable for losses arising from unauthorized use of your account.
You retain ownership of the content you submit to the Services ("User Content"). By submitting User Content, you grant Let's Ride a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, and distribute that content for the purpose of operating and improving the Services.
You are solely responsible for your User Content and represent that you have the rights necessary to submit it. We may, but are not obligated to, review, remove, or restrict User Content that violates these Terms.
You agree not to:
There is no tolerance for objectionable content or abusive riders. Report anything that breaks these rules. A person on our team reviews reports, normally within 24 hours, and removes content and riders that break them; serious reports are hidden while they wait.
This section is a release: you accept the risks of off-road riding and give up some claims against us, including for our ordinary negligence.
Off-road riding is dangerous. Off-road riding, overlanding, camping, and related activities can lead to serious injury, death, and damage to property. The risks include, among others: rollovers, collisions, and mechanical failure; changing terrain, washouts, drop-offs, water crossings, sand, mud, snow, and ice; heat, cold, storms, fire, and flash floods; wildlife; getting lost or stranded; no cell signal, and help that is slow or never comes; a check-in alert that is late, wrong, or never sent; the actions of other riders and drivers; and closed, private, or restricted land.
We don't run the trails. Let's Ride does not operate, inspect, maintain, or patrol any trail, route, place, event, or business shown in the Services, and does not supervise rides. Trail, route, place, closure, signal, and other information comes from riders, public agencies, businesses, and our own research. It can be incomplete, out of date, or wrong, and conditions change. Check it against official sources and what you see in front of you, and turn around when in doubt. You decide whether, where, when, and how to ride, and you are responsible for your vehicle, gear, skill, passengers, and following land-use rules, permits, closures, and the law.
You accept the risks. By using the Services, you knowingly and voluntarily accept the risks of your off-road and outdoor activities, including the risk that information in the Services is wrong.
Release. To the fullest extent the law allows, you release, for yourself and for your heirs, estate, and anyone claiming through you, Let's Ride and its members, managers, employees, and agents from claims for injury, death, or damage to property arising from your off-road or outdoor activities or your use of the Services, including information in them and check-in alerts (Section 6), and including claims based on our ordinary negligence. This release does not cover gross negligence, willful or reckless misconduct, or anything else the law that applies does not allow to be released, and it does not take away any right that cannot be waived by contract. If any part of this section cannot be enforced, it will be limited only as much as needed, and the rest still applies.
Riders under 18. A rider under 18 may be able to cancel this release under their state's law, and it does not bind a parent who has not agreed to it. The risks above are the same for every rider, whatever their age.
Check-in alerts let you name an emergency contact who is told by text message when you start a ride, if you are not back by the time you set, or if you report that you are hurt, or broken down and ask us to tell them. By using check-in alerts you agree that:
If you buy a paid plan, such as a membership or a business plan, it is billed in advance on a recurring basis, and you authorize us to charge your payment method for that plan's fee until you cancel. You can cancel as described when you buy; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial periods except where required by law.
Giveaway entries earned through the Services have no cash value, are not transferable, and may expire. Eligibility, sponsor terms, and applicable laws govern each giveaway. We reserve the right to modify, suspend, or end the rewards program, with reasonable notice where required.
If you operate a business profile on the Services, you are responsible for the accuracy of your business information and for honoring bookings, promotions, and other commitments you make through the Services. We are not a party to any transaction between a business and a rider.
The Services, excluding User Content, are owned by Let's Ride and its licensors and are protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal or internal business use, subject to these Terms.
The Services may include or link to third-party services (e.g., Mapbox, Apple App Store, Google Play, payment processors). We are not responsible for third-party services, and your use of them is governed by their terms and policies.
You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you violate these Terms or for any other reason permitted by law. Upon termination, your right to access the Services ends. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, and dispute resolution.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE FULLEST EXTENT PERMITTED BY LAW, LET'S RIDE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) USD $100.
Nothing in Sections 13–14 limits liability for gross negligence, willful misconduct, or anything the law doesn't allow to be limited.
You agree to indemnify and hold Let's Ride and its members, managers, officers, employees, and agents harmless from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms.
These Terms, and any claim arising out of them or the Services, are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Laramie County, Wyoming, and you and we consent to personal jurisdiction in those courts. Either of us may instead bring an individual claim in a small claims court where you live, if the claim qualifies. Before you file, please email support@letsrideoffroad.com so we can try to put it right. These Terms have no arbitration agreement.
Nothing in these Terms takes away a right you have under the consumer protection laws of the state where you live that cannot be waived by contract, including any right those laws give you to bring a claim in your home state. If any part of these Terms is found unenforceable, it will be limited only as much as needed, and the rest stays in effect.
We may update these Terms from time to time. If we make material changes, we will notify you through the Services or by email. Your continued use of the Services after changes take effect means you accept the updated Terms.
